<p>I hope you had a great weekend. I went racing on Saturday with Karen Hanover at the Richard Petty Raceway in Orlando. We raced real NASCAR stock cars. Man, were they fast! We were going 130mph around corners. If you ever get a chance to do this, I highly suggest it.</p>
<p>While Karen was in town, we went to see a few big multi-family REOs we’re working on.</p>

<p>There’s a ton of money in REOs right now. One of the biggest causes of this huge wave of REOs hitting right now is the shadow inventory that was created by our trusty government’s moratoriums and loss mitigation programs.</p>
<p>These programs were a huge failure and actually made the foreclosure situation worse. What it really did was delay the inevitable foreclosures from hitting the market sooner. It created a backlog of REO properties which is called shadow inventory of homes in the foreclosure process that the lenders are now getting back in droves.  They have so many REOs and they’re trying to get rid of them as fast as possible, so you can pick them up for a song and flip them the same day for quick profits.</p>
<p>Many people say you can’t double close an REO because the bank is the seller but this is completely false. The people that say that are uninformed because they haven’t taken the time to learn our strategy for double closing REO deals. It’s just like anything. If they don’t know how to do it, they say it can’t be done. The more you learn, the more you earn because knowledge is power.</p>

<p>Some of the most <strong>profitable short sales</strong> I’ve ever done were a direct result of big 2nd mortgages. This is because of the huge discount 2nd mortgage holders are willing to accept because they’re in a junior position and will not get anything if the first <strong>mortgage forecloses </strong>on the property. They will be wiped out and get nothing. It’s very common for my negotiators to get them to take 5-10% of the mortgage balance on a 2nd mortgage.</p>
<p>This means if they are owed, 252,000 on a 2nd mortgage, the lender is willing to take 5-10% of the balance which will end up being somewhere between $12,600 and $25,200. You just created $226,800 out of thin air. Luxury homeowners are willing to sell for what they owe because they know they have no equity so they’re much easier to acquire than luxury homes that have equity. When a luxury homeowner has equity, they want to get the $$$ for that equity. When they don’t have any equity, they know they don’t have any other options except for a short sale.</p>

<p>Now, housing analysts are drawing more attention to one big problem that’s making loan modifications less successful and drawing out efforts to pursue short sales and other foreclosure alternatives: The presence of second mortgages such as home equity loans and lines of credit.</p>
<p>Today’s Heard on the Street in the WSJ concisely explains why there’s a problem: Second mortgages stand behind the first lien and are supposed to take the first loss in a modification or short sale, and in the event of a foreclosure, they’re likely to be worthless, particularly if the home is underwater. Karen Shaw Petrou, an analyst at Federal Financial Analytics, concludes that most second mortgages “are nothing but air” because of big home price declines.</p>
<p>Second mortgages are held primarily by banks, and writing down seconds en masse would cause substantial losses at a time when banks are trying to boost their weakened balance sheets. Of some $1.05 trillion in second mortgages, $963 billion are on the balance sheets of commercial banks, savings institutions and credit unions, according to Amherst Securities, and around $442 billion sits with the nation’s four big banks.</p>
<p>But most modification activity centers on first mortgages, which are held by both banks and other mortgage investors, including government-owned mortgage-finance giants Fannie Mae and Freddie Mac.</p>
<p>Second mortgages are also a big stumbling block on short sales done by real estate agents without investors involved, where the borrower sells the home for less than the value of the amount owed. Real-estate agents have complained for months that many of these deals fall through because the second-lien holder isn’t willing to approve the deal, or is requiring more money from the transaction.</p>
<p>With my system of working with real estate agents, we can easily get these deals done that agents cannot get done because of the away we structure our deals. Its much more flexible than the way real estate agents do short sales. We pre-negotiate the short sale and we close 5 times more deals that realtors because of our pre-negotiation strategy.</p>

<p>D.C. I don’t submit any earnest money down. You need to position yourself as the expert and the solution to the real estate agent and their seller. They need to follow your guidelines. The holidays are upon us. Me and Tyler went out Christmas shopping this weekend and there doesn’t look like there is any signs of a recession based on the crowds of people buying stuff at the mall.</p>

<p>Here’s an article I found written by Britanny Dunn 12/11/09 that shows what’s coming in 2010.<br />
As many exotic adjustable rate mortgages (ARMs) are set to recast in 2010, the Consumer Mortgage Audit Center (CMAC) is projecting a mortgage crisis in 2010 as large as the subprime.</p>
<p>“We’ve spoken to Florida attorneys who sit at the forefront of the U.S. foreclosure crisis and have learned that 53 percent expect recasting ARMs to present a mortgage crisis as large as subprime and 61 percent expect to work on more loan modifications in 2010 than they did in 2009,” said Sylvia Alayon, VP of operations for CMAC “The New Year is going to hold very rude awakenings for some homeowners, but there are things you can do to analyze your situation and get help if you need it.”</p>
<p>Option ARMs enable borrowers to make monthly payments that are interest and principal, interest only, or just part of the interest due. After months and years of paying less than their full monthly payment of both interest and principal, many homeowners accumulate negative amortization. This means the amount of interest due on a loan becomes higher than the amount of the actual loan itself. As the majority of ARMs begin to recast in early 2010, housing bills will inflate, and many homeowners will be forced to repay the negative amortized balances.</p>
<p>“Recasting will undoubtedly lead to another wave of foreclosures as payments begin to double and triple,” Alayon said. “When principal balances go up and house values continue to plummet, refinancing will no longer be an option for homeowners in negative amortization.”</p>
<p>According to Alayon, only a few option ARMS in existence have been modified, but she believes many more homeowners will rush to modify their loans as they slip closer to negative amortization. Homeowners who act now to modify exotic mortgages may be saved from negative amortization and eventually foreclosure, Alayon said.</p>
<p>“Depending on each homeowner’s unique financial situation, we’ve seen everything from lenders modifying mortgages lower to make them affordable again to Fannie Mae allowing homeowners facing foreclosure to shift from homeownership to home rental,” said Alayon. “Options are out there, but you have to do some work to get to them.”</p>
<p>The data used to create CMAC’s prediction of a major mortgage crisis in 2010 came from the responses of 150 Florida Bar Association attorneys from November 3 to November 6, 2009, in a survey sponsored by CMAC. Responding attorneys specialized in real estate, general practice, civil law, and foreclosure defense.</p>

The company boasts a specialized team of mortgage experts who are also members of the American College of Forensic Examiners and represent a combined experience of over 80 years in mortgage finance and law.</p>
<p>As you can see, we’re not even half way through this foreclosure crisis. Its only the tip of the iceberg and this next wave is going to be bigger that what we’ve seen in the past 2 years.</p>

<p>In Tampa, Florida area particularly, the rents, occupancy rates, and values for commercial properties have been dropped and according to the assumptions by New York based Real Capital Analytics it will drop more day by day.</p>
<p>At the time when there was a boom in housing industry, a lot of houses more than its limit were built in Tampa which contributed to commercial foreclosures.</p>
<p>According to senior market analyst for Real Capital, Mr Ben Thypin, this overbuilding drove the prices of that area to a weak level. Even if the properties were taken back, it was really difficult to recover from the loss.</p>
<p>When the losers sell their properties, they are actually not recovering their losses.  In fact,  Tampa. Florida is among the cities with the lowest recovery rates.</p>
<p>According to a report, the recovery rate of this area is about 46 percent. There was a national wide recovery rate of 60 percent, which included the recovery of $ 1.9 billion by the lenders. The report which commented on Tampa, Florida  had a look at 145 commercial states over the nation with a balance of $ 3.2.</p>
<p>Everyone over there knows that if they close down, then the situation could become even worse than it is right now.</p>
<p>According to Real Capital, a minimum amount of $ 130 billion are in <strong>commercial foreclosure</strong>.</p>
<p>In the current year <strong>Commercial foreclosures properties</strong> of over $ 9.5 billion has been sold and taken back by the lenders.</p>
<p>The loans are still on the halfway. Time will decide whether the loans will be in profit or not. At the time oh housing, people were financed 70 to 80 percent and now when the prices have dropped, the owners are facing a difficulty of refinancing.</p>
<p>In the late July this year, California based first American Corelogic said that the TAMPA bay area was having $132 million of loan. A more of $ 204 million loan was expected to mature this year.</p>
<p>Huge amount of loans are kept pending for the next year. People wish to improve the condition of this area as soon as possible because if the market doesn’t improve, it would be difficult for owners to refinance.</p>
<p>Thypin also said that they can’t even think of how worse it could go to.</p>

    <strong>How  do I know this?  Because I tested it and  proved it! </strong></p>
<p>
  I let the property taxes on one of my subject-to houses  go behind and I only received ONE letter from an investor offering to buy the  house from me. And I use this strategy and the response I get from my direct  mail to luxury homes and commercial properties behind on taxes is  incredible!  </p>
<p>
  Nobody except for this one investor in this area is  using this strategy and it is a very powerful strategy to use once you  implement it. </p>
<p>
  Here&#8217;s the step by step process I use to find these HOT  Deals: </p>
<p>
  <strong>Step  1:</strong><br />
  <strong>Find  the website for the tax collector in the county you want to acquire your short  sales in. </strong></p>
<p>
  Go to Google and type in the term &quot;_____________county  tax certificates&quot; and if the tax certificate listings are online, you will find  the site. </p>
<p>
  For Example: </p>
<p> I typed in &quot;polk county tax certificates&quot;<br />
  And Google returned these search results: </p>
<p>

  You are looking for the site that advertises all of the  tax certificates for sale because those are all of the properties in that county  that are 2 years behind on taxes. This list will include any property behind on  taxes where the taxes and insurance are not escrowed into the mortgage payment. </p>
<p>
  (If the taxes and insurance are escrowed into the  mortgage payment, it will not be behind because the mortgage company will pay  the taxes even if the homeowner does not pay the mortgage. This is why  properties rarely ever get foreclosed on for taxes because they mortgage  company will pay off the taxes so they don&#8217;t get foreclosed off!) – Be careful  of the GURU&#8217;s that tell you that it&#8217;s possible to buy properties for $312.00 in  back taxes! &#8212; it&#8217;s a joke- it doesn&#8217;t work because the mortgage lender will pay  the back taxes to protect their mortgage position. </p>
<p>
  <strong>Step  2:</strong><br />
  <strong>Download  the list of Current Tax certificates available. </strong></p>
<p>
  The list will include the Parcel Id for the property</p>
<p><strong>Step  3:</strong><br />
    <strong>Cross  reference the Parcel ID for each property to the property appraiser website and  create a list. </strong></p>
<p>
  Include this data in the list (in separate Columns:<br />
  Owner First Name<br />
  Owner Last Name<br />
  Mailing address:<br />
  City<br />
  State<br />
  ZIP <br />
  Assessed Value <br />
  Zoning (ei: SFR, commercial, etc)</p>
<p>
  Any other data you want to sort your list by<br />
